1. ACCEPTANCE OF TERMS
By accessing or purchasing from this website, you agree to be bound by these Terms of Service.
If you do not agree, do not use this website.
2. PRODUCTS
We sell non-hazardous consumer goods such as flags, caps, and related accessories.
Minor variations in color, stitching, material texture, or design do not constitute defects.
Product images are for illustrative purposes only.
3. ORDERS
All orders are subject to acceptance.
We reserve the right to cancel or refuse any order at our sole discretion, including suspected fraud or pricing errors.
4. SHIPPING & DELIVERY
Products are shipped via third-party suppliers (dropshipping model).
Delivery times are estimates only and not guaranteed.
We are not responsible for carrier delays, lost or stolen packages after carrier confirmation, customs delays, import duties, or local taxes.
Customer is responsible for any applicable import duties or taxes.
5. RETURNS
Returns are accepted only if:
- Requested within 14 days of delivery
- Authorized in writing
- Returned unused and in original condition
Return shipping costs are the responsibility of the customer.
Used, damaged, or worn items are not eligible for refund.
Customized items are non-returnable.
6. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
ALL PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE PAID.
WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS.
8. PRODUCT USE
Customer is responsible for proper and safe use of products.
Caps and textile items should be kept away from open flames.
Products are not intended for children under 3 years if containing small parts.
9. INDEMNIFICATION
Customer agrees to indemnify and hold harmless Tas & De Vries Commerce VOF from claims arising from improper use, misuse, alteration of products, or violation of these Terms.
10. CHARGEBACKS
Customer agrees to contact us before initiating a chargeback.
Fraudulent chargebacks may result in recovery action.
11. DISPUTE RESOLUTION
Any dispute shall be resolved through binding arbitration on an individual basis.
Customer waives jury trial and class actions.
12. GOVERNING LAW
These Terms are governed by Dutch law, subject to mandatory consumer protections applicable in the customer’s jurisdiction.
